TOPIC:  Regulatory Changes on Supervision of Cross-border Capital Flows: A focus on China (Shanghai) Pilot Free Trade Zone

SH FTZ has been under the global spotlight since its establishment in September 2013 or even before. The whole world has been wondering what its purposes are, to what extent its economic reforms would be and what real benefits it could bring. The Framework Plan and the Negative List in 2013 seem do not make much a difference. However, with almost 1 year passing, just as announced by the MOFCOM, driven by the need to reform, ‘SH FTZ’S openness is unprecedented’. More and more industries and areas have been opened, specific policies supporting SH FTZ issued, executive procedures simplified and SH FTZ’s experience replicated and promoted to the whole nation. Individuals and enterprises change their tunes from ‘wait and see’ and act quickly in response. According to the official statistics, till the end of June, 2014, the enterprises based in SH FTZ have been near 9,000.

Obviously, the need of SH FTZ-centered legal services would increase rapidly. An undisputable fact is that no matter external lawyers or in-house legal counsels should equip ourselves with a better understanding of the SH FTZ legal policies in order to be more competitive and productive. The finance area in SH FTZ is a key point worthy of close attentions among which the new scheme of cross-border RMB supervision is definitely worth deep exploration for its impacts on funds sources and channels.

The session is roughly planned to be divided into 3 major parts. Dr.YE will give a brief overview of the development and latest progress of the newly-established SH FTZ first and then she will focus and elaborate on the regulatory modifications and breakthroughs have been uniquely designed for the cross-border RMB supervision in SH FTZ and their factual and potential influences. In addition, a Q&A or free discussion part is also welcome. (The session structure and content may be subject to adjustment.)

SPEAKER: Dr. Amy Fang YE

Dr. Amy Fang YE is a partner of AllBright Law Offices and mainly based in Shanghaiincluding SH FTZ and Beijing.

Dr. YE’s practice mainly focuses on out-bound & in-bound investment, real estate, bank finance, trust, M&A and dispute resolution. At present she is the standing legal counsel of SH UDC Business Consulting Co., Ltd. (‘Authorized Outsourcing Service Provider by SH FTZ Administration’) and has participated the discussion courses of SH FTZ Ordinances Draft upon invitation. At the same time, she has also hosted or delivered a series of lectures, seminars, workshops on SH FTZ to bankers, entrepreneurs, government officials and lawyers. She is providing various SH FTZ related legal services based on her familiarity with the normal practices.
