TOPIC: Discovery and privilege – overview of laws on discovery and privilege, case studies and practical tips on maintaining privilege
Discovery of documents is the ongoing duty of the parties in litigation proceedings. As discovery extends to pre-action discovery and discovery against third parties after the implementation of the Civil Justice Reform in 2009, so it is vital, whether for a party to the proceedings or a non-party who is ordered by court to make disclosure, to do so accurately in order to avoid adverse consequences if it later transpires that relevant material was not disclosed, or inadvertently discloses some irrelevant or privileged materials.
Given that the wide scope of matters that is subject to disclosure in litigation proceedings, legal professional privilege is the most important and often only means which a party has to resist disclosure of relevant documents and information. Yet, rules governing legal professional privilege are relatively complex and application not always clear cut.
The purpose of this seminar is to provide a comprehensive overview of discovery and legal professional privilege in Hong Kong legal proceedings to in-house counsel.
The speaker will share practical tips, experience and case study relating to the document management and preservation of privilege.
SPEAKER: Ms. Wynne Mok, Partner, Norton Rose Fulbright
Wynne is a dispute resolution partner based in Hong Kong, handling cases in a broad range of areas including commercial litigation, securities investigations, contentious trust and probate, and employment.
She has particular expertise in acting for listed companies with operations in the PRC that are listed in Hong Kong, its directors and employees in SFC and SEHK investigations and a large proportion for her work has this cross border element.
Wynne also has solid experience in handling professional negligence cases relating to solicitors, accountants and medical practitioners and advising Insurers and Reinsurers on policy interpretation and indemnity issues.
