Arbitration in Action: A Guided Tour of Rules and Clauses
Arbitration is increasingly favoured by parties as the dispute resolution method of choice in cross-border transactions, particularly those involving emerging markets. In light of this, ensuring you have an effective arbitration clause to implement that choice is critical. A lack of proper attention to essential elements of an arbitration clause may give rise to unanticipated delays and increased costs during the arbitral proceedings.
This seminar brings together arbitration experts from Allen & Overy and HKIAC to give in-house counsel a guided tour of the pros and cons of common choices made regarding the applicable procedural rules and the law governing the arbitration agreement, including an examination of the different drafting approaches taken by institutions in their model arbitration clauses, with a focus on reducing uncertainty and minimising the risk of incurring unnecessary expense and delay. Knowing that corporate counsel may not always have the tools to conduct a detailed review of these matters, our speakers will provide key take-away points on the suitability of these rules and clauses for transactions in different industries at the end of the tour.
