TOPIC: The Hong Kong Competition Ordinance: How it may impact your business.
The Hong Kong Competition Ordinance was enacted in 2012 and is due to come into effect on 14 December 2015.
Under the new rules, any discussion of pricing or other commercially sensitive information with competitors will create risks and could lead to the imposition of fines by the Competition Tribunal. The new regime may also impact how businesses can influence the commercial policies of their suppliers, distributors or agents. Resale price obligations, exclusivity or non-compete clauses may need to be reviewed and amended to ensure compliance.
This seminar will focus on the key substantive and procedural aspects of the new Ordinance. We will share our experience of how similar competition rules have impacted businesses overseas and share practical compliance tips.
SPEAKER: Maxime Vanhollebeke
Maxime Vanhollebeke is an antitrust, competition and regulatory lawyer based in Hong Kong.
Maxime advises international companies on emerging antitrust regimes in East Asia, and Asian companies on global competition compliance issues, multi-jurisdictional merger filings, abuse of market power issues and international cartel investigations. His practice is informed by his prior experience as an in-house competition advisor in Europe, were Maxime worked extensively on abuse of market power and cartel-like behaviour.
Maxime regularly publishes and participates in conferences or seminars on Asia competition law issues and he has been actively involved in the design and implementation of competition compliance programmes as well as training programmes for Asian competition regulators.
