TOPIC:  Latest Trends in International Commercial Arbitration

Statistics from international arbitral institutions throughout the world have shown a significant growth in the number of international disputes submitted to arbitration. Such growth is particularly prominent in Asia. Keeping abreast of developments in international arbitration is becoming increasingly essential for any in-house counsel involved in cross-border transactions.

This seminar will discuss recent updates in the arbitration rules of arbitral institutions commonly used in international transactions in Asia and whether issues arising from the internal rift in the China International Economic and Trade Arbitration Commission (CIETAC) would impact the drafting of CIETAC arbitration clauses in China-related transactions. Lawyers from O’Melveny & Myers will also discuss how to effectively manage an arbitration from an in-house counsel’s perspective.


SPEAKER:

Desmond Ang, Counsel, O’Melveny & Myers

Desmond Ang is a counsel in O’Melveny’s Hong Kong office and a Registered Foreign Lawyer in O’Melveny’s Singapore office. Desmond specializes in international commercial arbitration with a recent focus on high-stakes disputes related to China, Japan and South Korea. Desmond has represented clients in proceedings conducted under the ICC, HKIAC, CIETAC, SIAC, JCAA, AAA and UNCITRAL Arbitration Rules as well as experience in arbitrations conducted under the auspices of other institutional rules such as ICSID and the SCC. His recent experience has included joint venture disputes, patent royalties disputes, private equity disputes and sports arbitration in arbitral fora such as Hong Kong, Singapore, Japan, California and Switzerland. He also has experience in litigation ancillary to international arbitrations, including enforcement and Mareva proceedings before the Singapore High Court.

Yan Zhang, Counsel, O’Melveny & Myers

Yan Zhang is a counsel in O’Melveny’s Hong Kong office. Yan has experience in both adversarial and transactional work and represents clients from a broad range of sectors. In her adversarial practice, Yan is experienced in the resolution of Chinese-foreign business disputes and has advised clients in proceedings conducted under a number of institutional arbitration rules including those of the HKIAC, AAA and CIETAC. In her transactional practice, Yan represents private equity funds, hedge funds, multinational companies in mergers and acquisitions, reorganizations, fund formation and other general corporate matters.
