TOPIC:        Light touch Restructuring: cross-border insolvency and restructuring

The seminar will discuss cross-border insolvency and restructuring and the use of light touch restructuring. Within this broad heading the speakers will discuss the insolvency and restructuring procedures in BVI, Cayman and Bermuda, the power to wind up a foreign company in Hong Kong and also the Yung Kee case and some other significant cases. The seminar will also cover areas such as provisional liquidation, parallel schemes of arrangement and aspects of investigations and fraud.

Any in-house counsel who come across BVI, Cayman and Bermuda entities in their business dealings should attend this helpful seminar to learn about the key cornerstones of BVI, Cayman and Bermuda restructuring and insolvency principles and its relevance to the Hong Kong business community.

Ian Mann, Partner, Harneys.

Ian Mann is head of Harneys' Offshore Litigation and Restructuring Department in Hong Kong servicing Asia-based clients involved in Offshore litigation.

Ian joined Harneys in 2009 and became a partner in 2011. He specialises in cross border insolvency advising debtors and creditors on all aspects of restructuring and insolvency.
Ian is an experienced advocate who has a number of reported cases in the High Court and Court of Appeal in England. He continues to appear regularly as an advocate in the Commercial Division of the Eastern Caribbean Supreme Court and Court of Appeal. Prior to moving offshore, Ian practised as a barrister at 13 King's Bench Walk, chambers of Roger Ellis QC, London.
Ian is the co-author of the leading text book British Virgin Islands Commercial Law, Sweet & Maxwell Thomson Reuters (now in its third edition) and in particular, wrote the chapter on insolvency in the BVI.
Ian is ranked as a Tier 1 lawyer in Asia in the 2015 edition of Chambers & Partners where he is described as a "very seasoned adviser" and is singled out for his extensive expertise in shareholder disputes and insolvencies. Chambers say that clients appreciate his "practical advice and insight of the commercial realities" in a transaction.
Ian is also recommended as a leading lawyer in the 2014 edition of Legal 500 where he is described as "a pleasure to work with". In the 2014 edition of Chambers & Partners, Asia-Pacific, he was recommended for his "established reputation in the region for handling a wide range of corporate disputes".

He is a member of the firm’s Restructuring and Insolvency Group in Hong Kong and supports Ian Mann in leading the practice in Asia Pacific.

Chai specialises in cross-border restructurings, insolvency and workouts of distressed companies. Chai consistently advises leading international and regional accountancy practices, onshore law firms, financial institutions , insolvency office holders, official and unofficial creditors’ committees, private equity sponsors, hedge funds, debtor in possession loan providers, directors, trustees, shareholders and corporate debtors. Chai has worked extensively on assignments throughout Asia, including in the People’s Republic of China, Hong Kong, Japan, Singapore and South Korea. 
Prior to joining the firm, Chai was a senior associate at a global law firm in Singapore and London.
