IP Protection in China: Case Studies of Common Pitfalls

On 19 January 2017, Joe Simone, Founder, SIPS and Dan Plane, Director, SIPS brought a number of common pitfalls in China to life through practical, real world examples arising in cases they had dealt with in the PRC. These types of “war stories” were considered really helpful to HKCCA Members in trying to illustrate to commercial teams the need for caution and a proactive approach to IP problems. Among the case studies that were presented were the fraud by service providers in IP enforcement work; dealing with bad faith trademark piracy through invalidations and negotiated purchases; getting product out of China relying on the “OEM exception”; innovative ways of addressing counterfeiting of fake alcoholic beverages and structuring small-scale online enforcement programs.
