TOPIC: Directors' and Officers' Liability Insurance
With the wholesale amendments to the Companies Ordinance coming into force earlier this year, in house counsel will be guided through the new regime as regards directors' duties and the operation of Directors' and Officers' Liability insurance in managing the risks attendant on such obligations.
SPEAKER: Gareth Thomas -Partner, Herbert Smith Freehills
Gareth is responsible for the firm's Hong Kong commercial litigation and Asia insurance practices. On the insurance side, Gareth's experience in London and Hong Kong has included advising clients on all aspects of international insurance and reinsurance law, both contentious and non-contentious, including disputes concerning policy interpretation, issues of non-disclosure and misrepresentation, breach of warranty and aggregation. He has handled regulatory matters, brokers' errors and omissions and reinsurance disputes. He has also handled for insurers claims against professionals and others, as well as matters involving questions of conflicts of law. His experience covers arbitration and mediation work, as well as litigation before the courts. On the non-contentious side, he has advised insurers on alternative risk transfers, mortgage pool securitisations, commercial mortgage indemnity policies, private finance initiatives and construction projects.
