TOPIC:  Smarter ways to obtain and manage your IP in China

The aim is to provide in-house counsels with practical tips and strategies to help build a smarter and more effective IP portfolio that adds value to their business.

David is a Partner within Bird & Bird's China IP team. David has extensive experience in all major areas of intellectual property, including trade marks, copyright, patents, and registered designs. He has managed disputes dealing with infringement of trade marks, copyright as well as the misuse of confidential information and trade secrets.

David's particular areas of interest include the prosecution of trade mark portfolios in Hong Kong and the greater China region, contentious intellectual property disputes, and the enforcement of intellectual property rights in both Hong Kong and mainland China. David regularly advises clients on non-contentious matters, particularly relating to personal data privacy.

Whilst having extensive litigation experience, David also has significant involvement and practice in alternative dispute resolution. He is an accredited mediator and is a member of the Chartered Institute of Arbitrators. He also sits as a panelist for the Asian Domain Name Dispute Resolution Centre in Hong Kong.

Prior to joining Bird & Bird, David worked for both multi-national and specialist law firms in Hong Kong and Australia in both IP and commercial litigation roles. He was also the Asia Pacific Regional IP Counsel for a major US MNC based in Shanghai.

David is qualified to practise law in the Supreme Court of Western Australia (2004), the High Court of Australia (2004) and the High Court of Hong Kong (2008).


 

Victor is a senior managing associate in our Intellectual Property practice, based in Hong Kong.

He has acted for many high profile technology companies, venture capital firms and financial institutions, advising on a broad range of legal issues involving technology, from obtaining protection for new products and services, commercialising technology through licensing, resolving disputes, and where necessary, enforcing rights through litigation.

Victor helps clients develop and implement strategies for exploiting IP rights more effectively, and for managing legal risks arising from a commercial launch or use of new technologies when faced with existing IP rights.

His litigation experience has touched upon a wide variety of technologies, including telecommunications, electronics, software, mining, medical devices and mechanical technologies. Victor has also assisted clients on disputes concerning the misappropriation of trade secrets and confidential information.

He is a registered Australian patent attorney, with considerable experience in drafting, analysing and prosecuting patent applications around the world.

Victor graduated from the University of Technology Sydney with Bachelor degrees (with honours) in both law and computing science. He also has a Masters degree in law from the University of Melbourne. Victor was admitted in New South Wales and Victoria (Australia) in 2002.

He has been appointed as co-chair of the APAA's International Emerging IP Rights Committee, and to sit on the IP Committee for the American Chamber of Commerce in Hong Kong.

Victor is fluent in English, Cantonese and Mandarin.
