TOPIC:  Best Practices in International Arbitration - Making it Work for You

Parties entering into international or cross-border contracts increasingly adopt arbitration as their dispute resolution mechanism. International arbitration is a private process with procedures adopted in accordance with the parties' agreement. Due to its flexible nature, arbitration gives the parties an opportunity to tailor the process in accordance with their expectations and needs. By far the best time to agree on a sensible way to resolve a contractual dispute is when the parties are negotiating their arbitration clause and before any dispute has arisen. However, parties also face a number of choices over the course of the arbitration.

Baker & McKenzie's International Arbitration team will present on:

  • Best practices in international arbitration in relation to key choices parties have To make when negotiating an arbitration clause (e.g. selection of the arbitral seat and arbitral rules) and at various stages of an arbitration (e.g. arbitrator selection, rules of evidence);
  • Guidance as to which options may be most suitable in any given situation; and
  • Latest developments in third party funding of arbitrations in Hong Kong
