TOPIC: Best Practices in International Arbitration - Making it Work for You
Parties entering into international or cross-border contracts increasingly adopt arbitration as their dispute resolution mechanism. International arbitration is a private process with procedures adopted in accordance with the parties' agreement. Due to its flexible nature, arbitration gives the parties an opportunity to tailor the process in accordance with their expectations and needs. By far the best time to agree on a sensible way to resolve a contractual dispute is when the parties are negotiating their arbitration clause and before any dispute has arisen. However, parties also face a number of choices over the course of the arbitration.

SPEAKERS: Nandakumar Ponniya, Partner; Philipp Hanusch, Senior Associate; and Andrew Chin, Senior Associate
Nandakumar (Kumar) Ponniya is a Partner in the Dispute Resolution Practice Group, based in Singapore. With 20 years experience, Kumar is a seasoned practitioner with a broad focus on dispute resolution, covering international arbitration, commercial litigation, corporate restructuring and insolvency. He also advises on investment arbitration matters in Asia and has a particular focus on oil and gas, infrastructure and construction sectors. He has worked on international arbitrations involving all the major arbitral rules including ICC, UNCITRAL, ICSID, SIAC, KLRCA, HKIAC and BANI; with hearings in multiple jurisdictions such as Singapore, Hong Kong, Kuala Lumpur, Jakarta, London and Mexico City.
Kumar is listed as a leading dispute resolution lawyer in Singapore, with Chambers Asia Pacific noting that he “stands out for his quickness and perspicacity” and has “a full and comprehensive knowledge of international arbitration and good analytical skill in dealing with cross-border commercial disputes”. Benchmark Asia Pacific has recognized him as a “leading disputes star” and “leading litigation star” in Singapore.
Kumar graduated with a LL.B (Hons) from National University of Singapore. He is admitted as an Attorney-at-Law in New York, a solicitor in England and Wales, and an advocate and solicitor of the Supreme Court of Singapore.
Philipp Hanusch is a Senior Associate in the Dispute Resolution Group in Hong Kong. His practice focuses on international commercial arbitration. He has represented parties in institutional arbitration proceedings under the HKIAC Rules, ICC Rules, CIETAC Rules, ICDR Rules, and Vienna Rules, and in ad hoc proceedings under the UNCITRAL Arbitration Rules. Philipp has been appointed twice as sole arbitrator in ICC arbitration proceedings (under the 1998 and 2012 ICC Rules) with seat in Hong Kong.
Before joining the Firm in February 2015, he worked as an associate for a major Hong Kong law firm for 8 years. Prior to that, he worked for a leading Austrian law firm for 7 years. In 2011, he was appointed legal counsel to the Austrian Consulate in Hong Kong.
Philipp graduated with an LL.M from University of London, and a Mag.iur. from University of Vienna. He is admitted as a solicitor in Hong Kong.
Andrew Chin is a Senior Associate in the Dispute Resolution Group in Hong Kong. He specialises in international and domestic arbitration, commercial dispute resolution, building, infrastructure, engineering disputes and has represented clients in Hong Kong and Singapore.
Andrew was the Honorary Treasurer of the Young Member’s Group of the Chartered Institute of Arbitrators (East Asia Branch) from 2012 – 2013 and the Vice Chairperson from 2013 - 2014.
Andrew graduated from Cambridge University with a Bachelor of Arts (Law) and from the London School of Economics with Masters of Laws. He is admitted as a solicitor in Hong Kong and Singapore
