TOPIC:  Cross-border Trade Litigation

Arguments are always inevitable among different individuals.  In order to resolve their disputes, people have found a way in settling them – handling over their power to a court as their decision maker.  However, it also consumes a longer period of time and a larger amount of money, which often poses a higher cost to both parties. Alternative dispute resolutions are therefore formed. 

On a more frequent scale, many corporate entities resolve their disputes by way of arbitration. The major concern was its enforceability in foreign jurisdictions.  In any event, Hong Kong is one of the, if not the, most popular jurisdiction to settle disputes by way of arbitration.  In this course, we shall discuss different arbitration rules common in Hong Kong and in particular, the UNCITRAL Model Rules.

Apart from arbitration, this seminar will also focus on mediation, in particular, the different methods of mediation and the normal process.

Finally, this seminar will also discuss the general High Court Civil Procedures Rules and in particular the enforceability of the Hong Kong judgment overseas. We shall further discuss such enforceability of the Hong Kong judgments in China and vice versa.

SPEAKER: Ronald Sum, Partner, Troutman Sanders

Ronald Sum concentrates his practice in all areas of dispute resolution, specialising in China related matters, cross border disputes, transportation, international trade, insurance and reinsurance, product liability and product recall, including arbitration, litigation, mediation and investigations.

He is a fellow member of the Hong Kong Institute of Arbitrators and fellow member of the Chartered Institute of Arbitrators. Ronald is the Chairman of the International Chamber of Commerce Arbitration and ADR Sub-Committee. He is on the panel of arbitrators of theHong Kong International Arbitration Centre (“HKIAC”) and has acted as arbitrator in HKIAC administered arbitration proceedings. Ronald is also on the Panel of Arbitrators of Shenzhen Court of International Arbitration. Ronald has conducted arbitrations in Hong Kong, Singapore, London, United States, and Australia. Ronald is also an accredited mediator of the Law Society of Hong Kong. Ronald is qualified to practice in Hong Kong, England and Wales and Australia.
