Half-Day Conference: Utilising International Arbitration to Maximise the Effective Protection of Cross-border Investments

The HKCCA’s Executive Committee is delighted to announce the first of the 2017 HKCCA Half-Day Conference Series, hosted by Kirkland and Ellis at the Mandarin Oriental on 28 February 2017.

Food and drinks will be provided. 

Three (3) Law Society of Hong Kong CPD points have been accredited, as well as three (3) New York CLE points. California Approved Jurisdiction policy may apply.

Partners from Kirkland & Ellis’ global offices together with industry experts will discuss the key issues surrounding international arbitration. This half-day conference will include sessions on:

Javier Rubinstein, Partner, Kirkland & Ellis, Chicago/New York

Javier Rubinstein is a partner in the International Arbitration & Dispute Resolution practice of Kirkland & Ellis LLP. Prior to joining Kirkland & Ellis, Javier was Vice Chairman and Global General Counsel of the PricewaterhouseCoopers network of firms spanning 157 countries. Javier also previously led the international arbitration practice at Mayer Brown LLP, where he was a partner for 17 years. Throughout his career, Javier has handled numerous high-profile international commercial and investment treaty arbitrations, representing clients from North America, Latin America, Europe and Asia in complex disputes. He also has handled trials and appeals in state and federal courts across the United States, including the U.S. Supreme Court.

Tiana Zhang, Partner, Kirkland & Ellis, Shanghai

Tianjing "Tiana" Zhang is a partner in the litigation practice of Kirkland & Ellis. Tiana is based in Shanghai where she advises clients on government investigations and dispute resolution. Trained in both the U.S. and China, Tiana has advised numerous multi-national companies with regard to legal and compliance issues arising from their business in China and around Asia, including issues relating to anti-corruption laws (including FCPA), antitrust laws, data security and privacy, U.S. securities laws, accounting and book-keeping practices and other internal control rules. She has extensive experience representing clients in a wide array of complex civil and commercial U.S. litigation and cross-border disputes.

Yi-Chin Ho, Partner, Kirkland & Ellis, Los Angeles

Yi-Chin Ho is a partner in the litigation practice of Kirkland & Ellis. Yi-Chin’s practice focuses on representing Chinese companies, based in the U.S. and abroad, ranging from multinational public companies to emerging companies, in antitrust and trade regulation, white collar and government investigations, securities fraud and investigations, class action, intellectual property and other complex, cross-border business litigation matters. She has litigated commercial disputes at all stages of arbitrations in federal and state courts throughout the United States, as well as before the California Court of Appeal, the Ninth Circuit Court of Appeals and the California Supreme Court. She has specific cross-cultural experience leading complex litigation matters to resolution on behalf of Chinese companies.

Kelly Naphtali, Partner, Kirkland & Ellis, Hong Kong

Kelly Naphtali is a partner in the litigation practice of Kirkland & Ellis. She has earned a well-deserved reputation for handling difficult commercial and insolvency related disputes, often requiring urgent action to prevent the movement or dissipation of assets. She has worked on claims in numerous jurisdictions and has a wealth of experience in managing and running cross-border litigation, including pursuing claims arising from corporate collapses. She is especially skilled with urgent applications whether they be appointments of Receivers or Provisional Liquidators and/or injunctions to freeze assets and obtain books and records.

Lauren Friedman, Partner, Kirkland & Ellis, New York

Lauren is a partner in Kirkland & Ellis LLP’s international arbitration group and is based in the New York office. She is a specialist in international arbitration and public international law, focused on investment-treaty arbitration and international commercial arbitration. She has represented states and foreign corporations under the auspices of ICSID, ICC and UNCITRAL. She has experience across a number of industries, particularly oil, mining, electricity, food distribution, gas, water, and airport services. Fluent in Spanish and English, Lauren has extensive experience in investment arbitration in Latin America.

Pui-Ki Emmanuelle Ta, Counsel, Secretariat, ICC International Court of Arbitration - Asia Office

Pui-Ki Emmanuelle Ta is the Counsel of the Secretariat of the ICC International Court of Arbitration – Asia Office, based in Hong Kong. She is currently a Vice-President of the Asia Pacific Regional Arbitration Group. Prior to that, Ms. Ta was deputy counsel of the ICC Court Secretariat in Paris, and was a founding member of its Asia- Office. She holds a law degree from the University Paris I Panthéon- Sorbonne, and is admitted to practice in France. She speaks French, English, Mandarin and Cantonese.

Cosimo Borrelli, Managing Director, Borrelli Walsh

Cosimo Borrelli is a Managing Director of Borrelli Walsh, a specialist restructuring, insolvency and forensic accounting firm with offices in Beijing, British Virgin Islands, Cayman Islands, Hong Kong, Jakarta and Singapore.

Cosimo is a Chartered Accountant with over 25 years of experience in formal and informal corporate restructuring, insolvency, forensic accounting and financial investigations. This experience has included being appointed by courts, lenders and financiers, distressed companies, secured and unsecured creditors, investors and other interested parties.

Cosimo has been involved in some of the region’s largest and most difficult corporate collapses and investigations in recent years. Cosimo is also well regarded for his work as a director of listed companies and currently holds directorships with publicly listed entities in Hong Kong, Singapore, Indonesia and the United States.

Kiran Sanghera, Associate Director of Litigation Funding, Harbour Litigation Funding.

Kiran is an Associate Director of Litigation Funding in Harbour’s Hong Kong office. Formerly Counsel at the Hong Kong International Arbitration Centre (HKIAC), Kiran managed the administration of commercial arbitrations involving parties from Asia, Europe and the Americas. Kiran uses her institutional experience gained in Asia, as well her experience gained in Europe and South America, to advance the use of third party funding in the Asia Pacific region. She has travelled worldwide, with a particular focus on Latin America, to promote the use of arbitration and other forms of dispute resolution.

Kim M. Rooney, Arbitrator, Barrister and Mediator, Gilt Chambers

Kim M. Rooney is an international arbitrator, barrister and mediator, who has practiced in Asia since 1990. Until late 2009, before moving to become an arbitrator and barrister, Kim was a partner of a leading international law firm, heading its international dispute resolution practice in Asia. Her experience includes representing investors and states in infrastructure disputes in the Philippines, Indonesia, and in other Asian jurisdictions under ICSID and other arbitration rules.

Kim is the Alternate Member of the ICC International Court of Arbitration for Hong Kong. She chaired the Hong Kong Law Reform Commission’s Sub-Committee on Third Party Funding for Arbitration; The Law Reform Commission’s Final Report on Third Party Funding for Arbitration was published on 12 October 2016 (annexing draft amendment legislation that is the basis for legislation introduced in the Hong Kong Legislative Council in January 2017). From 2013-2016, Kim was a senior expert in ADR in an EU-funded project in the Indonesian public sector concerning alternatives to litigation and arbitration for investor state disputes.
