TOPIC: IP Protection in China: Case Studies of Common Pitfalls 

This session will bring a number of common pitfalls in China to life through practical, real world examples arising in cases the speakers have dealt with in the PRC. These types of “war stories” are extremely helpful to in-house counsel trying to illustrate to commercial teams the need for caution and a proactive approach to IP problems. 

Among the case studies that will be presented are the following:

• Fraud by service providers in IP enforcement work;
• Dealing with bad faith trademark piracy through invalidations and negotiated purchases;
  
• Getting product out of China relying on the “OEM exception”;
  
• Innovative ways of addressing counterfeiting of fake alcoholic beverages;
  
• Structuring small-scale online enforcement programs.
  

SPEAKERS:  

Dan Plane, Director, SIPS ​Admitted in Australia, Hong Kong and Wisconsin (USA), Dan has practiced extensively in the US (as both a patent litigator and public prosecutor), Europe (as in-house anti-counterfeiting counsel for Nokia in the EMEA region) and in the PRC and Asia Pacific, both as in-house counsel for LVMH Fashion Group, as well as in private practice with two of the world's leading international law firms and one of Australia's premier IP practices. At SIPS, he primarily focuses on IP enforcement in the People’s Republic of China.

Joe Simone, Director, SIPS  ​Joe Simone is the founder and a Director of SIPS. Joe has advised companies on the protection of their IP rights in China since the mid-1980s. Most recently, Joe's association and publishing work has focused mainly on online counterfeiting and bad faith registration of trademarks in China. In the late 1990’s, Joe was involved in the creation of the QBPC and the Global Leaders Alliance Against Counterfeiting (now merged into BASCAP). He served as Vice Chairman of the QBPC for several years and remains active in its Legal Committee and Internet Task Force.
