TOPIC: Base Erosion and Profit Shifting (BEPS) Development in Hong Kong

On 26 October 2016, the Hong Kong Government issued a public consultation paper on a range of measures including, amongst others, a proposal to introduce specific transfer pricing (TP) rules for Hong Kong, with mandatory documentation requirement based on a three-tier country-by-country reporting approach (including a master file and local file).

The proposal is still under consideration as part of the consultation process, no draft legislation has been published at present and therefore the final measures implemented in Hong Kong may differ to the proposal.  However, it is very likely that the final legislation would be expected to pass through and come effective in 2017.    

The session will outline the new TP rules proposed in the consultation paper to give audience an overview of the obligations of preparing the TP documentation, details of the reporting requirements, and the implications to the business and costs of non-compliance.

John is a Partner in KPMG Hong Kong transfer pricing team. Having lived and worked in Asia for over 15 years, John has extensive experience in transfer pricing issues across the Asia-Pacific region with respect to Japan, Korea, Hong Kong, Singapore, Taiwan, China, India, Indonesia, Philippines, Vietnam, Thailand and Australia.

John serves clients in a wide range of industries including financial services, telecommunications, technology, retails and others.



Irene is a Director in KPMG Hong Kong transfer pricing team. She has over 10 years working as a full time transfer pricing specialist.

Irene has worked on a variety of transfer pricing clients and dealt with their transfer pricing issues in the past years. She has assisted various clients in planning, managing and documenting their transfer pricing policies in China, Hong Kong and across Asia-Pacific. She also led the delivery of regional transfer pricing compliance documentation for a number of major international clients.
