TOPIC: Resolving IP Disputes – Is Arbitration the Answer?

In this seminar, we will discuss recent significant developments in the arbitrability of disputes concerning intellectual property rights. Many commercial contracts such as licenses and technology transfer agreements include arbitration clauses for resolving contractual disputes.  Infringement and validity are not so easily arbitrable, either because there is no agreement or the parties prefer to litigate. Hong Kong recently passed legislation clarifying the arbitrability of disputes involving intellectual property rights.  The advantages of arbitrating intellectual property disputes, drafting arbitration clauses involving intellectual property rights, and enforcement of an award involving intellectual property rights on the Mainland and will be covered.

With a focus on resolving complex disputes in the healthcare/life sciences/medical devices, construction and infrastructure, technology, and energy sectors, James Kwan is an International Arbitration partner based in the Hong Kong office. He has represented clients in complex arbitrations in Asia, the U.S., the Middle East, and Europe under the major institutional rules such as ICC, HKIAC, SIAC, CIETAC, AAA, LCIA, DIAC, CAS, and in ad hoc arbitrations. 

James is widely recognised as a leading individual in International Arbitration by major legal directories, such as Asia Pacific Legal 500, Chambers Asia Pacific and Global, Euromoney’s Guide to the World’s Leading Arbitration Lawyers, Practical Law Company’s Which Lawyer?, Benchmark Asia Pacific: Arbitration, Global Law Expert and named one of Asian Legal Business’ Hot 100 Lawyers of 2008 and 2011.

Henry is a qualified solicitor in Hong Kong and England and Wales with a practice spanning some 40 years.  He is counsel to the Hogan Lovells Hong Kong intellectual  property group with an emphasis on rights management and enforcement. He concentrates on contentious matters, including cross-border disputes, relating to trade marks, copyright, patents and designs, confidential information and technology transfer. He also advises on the arbitrability of IP disputes and was one of the lawyers advising the government on its amendment to the Arbitration Ordinance to facilitate IP arbitration.

Highly practical, he goes to great lengths to get to grips with the fine details of clients’ businesses and objectives.  He is named as a leading lawyer in publications including Managing Intellectual Property, Legal 500, Chambers, World Trademark Review and Who's Who of Life Sciences and Patents.
