TOPIC:  Social Media Discovery

Social media has become an important source of evidence and information.  Social media discovery tools have been increasingly used for sourcing evidence and information for investigation, litigation and employment disputes.   Specifically, this panel discussion consider the following:

  • What is social media discovery;
  • How can social media discovery tools be used in employment disputes and investigations;
  • What are the legal issues to bear in mind when using these tools; and
  • What companies should consider when formulating its social media policy.


SPEAKERS

 

Anita Lam, Consultant, Head of Employment, Clifford Chance

Anita practises across all areas of employment law, with a particular focus on contentious employment, discrimination and data privacy disputes. As a seasoned litigator, Anita is one of the very few solicitors in Hong Kong who has Higher Rights of Audience granted by the Higher Rights Assessment Board.

Anita's clients include banks; listed companies; airlines; tertiary institutions; hospitals; theme park; stock brokers; foreign law firms; railway corporation; tunnel operators; publisher; pharmaceutical companies; fashion retailers.

 

Rachel Cheng, Senior Associate, Clifford Chance

Rachel Cheng regularly advises client on day-to-day employment related issues such drafting and negotiations of employment contracts, review of employment handbooks and employees' benefits and bonus schemes, personal data privacy issues, immigration matters, discrimination claims, termination and entitlement disputes. She also advises on corporate transactions involving the sale of business and transfer or termination of employees in such situation.

Annie commenced her professional career as a Hong Kong and England and Wales qualified lawyer.  She graduated from the University of Lancaster with a BA Honours in English.  Subsequently, Annie embarked on legal studies and studied the Legal Practice Course at the College of Law, York and a legal career ensued in 1995 after she relocated to Hong Kong.  She trained with an international UK law firm in Hong Kong and qualified in 1997 and practised for a number of years in dispute resolution with international law firms before switching careers into legal recruitment in 2005.
