TOPIC:  Fraught with fraud – red flags and corporate governance

Fraud is like a virus that all businesses carry, and if left undetected, can fester and ultimately bring your business down.  Robust safeguards can slow fraud down, but cannot offer immunity, since fraudsters will adapt their behaviour to get what they want.

Early detection and knowing how to respond to fraud can be the difference between saving your business and total collapse.  In this interactive session Simmons & Simmons and Control Risks look at the most common frauds used, and through a series of case studies, help you identify red flags, learn how to read them, and plan what to do once fraud is detected.  We also look at examples of fraud in the People’s Republic of China, tracing of assets, and how to approach fraud investigations.

SPEAKERS
Mavis Tan, Senior Partner, Control Risks

Mavis Tan is a Senior Partner in Control Risks, based in Hong Kong. She leads Control Risks’ forensics practice for Greater China and North Asia. She has specialised in forensic accounting, litigation support and insolvency for more than 15 years, and has extensive experience in leading high-profile and confidential investigations in the Asia Pacific region. She has also managed hundreds of company liquidations, restructurings and receiverships.

Melissa Chim, Consultant, Simmons & Simmons

Melissa Chim specialises in financial markets disputes, investigations and contentious regulatory matters. These include proceedings in the MMT, mis-selling claims and regulatory, ICAC and police investigations. She also has extensive experience in commercial litigation (including shareholders and joint venture disputes, fraud claims and professional negligence claims). Melissa qualified as a Solicitor in Hong Kong in 2003 and in England in 2008. In 2005, Melissa became an accredited mediator of the Hong Kong International Arbitration Centre’s (General) Panel of Mediators. She has mediated a number of disputes since and has given seminars and training on mediation. Melissa is currently an editor of the Hong Kong White Book 2018 (Orders 116 and 117).
