TOPIC:  Ethics in Electronic Communications

As technology evolves, email and social media platforms have been prevalent in the professional environment and a number of ethical issues have arisen from electronic communications by lawyers. While ethical rules remain unchanged in general, electronic communications may break the rules in new ways.

This seminar will discuss some key ethical considerations when it comes to the usage of electronic communications in the legal environment, covering issues in relation to privilege and confidentiality, conflicts of interest, marketing, advertising and solicitation. The speakers will also share their insights on what measures and tactics should be taken as a lawyer.

SPEAKERS

Scott Peterman

Partner, M&A and Private Equity

Scott Peterman focuses on representing private fund sponsors and investors in the formation of alternative investment vehicles, including pan-Asian private equity funds, venture capital funds, infrastructure and real estate funds, private REITs, hedge funds, hybrid funds, emerging manager platform funds, Hong Kong authorized funds, and emerging market ETFs. In addition, he has advised on more than 150 account arrangements, representing sovereign wealth funds, universities, seeding and first-loss capital programs, family offices and individual investors.

Scott offers clients a unique perspective with in-depth knowledge in the technology and telecommunications industries, having served for 13 years as a Silicon Valley senior executive prior to practicing law, including as Apple’s first country manager for China and Korea, director of Asia Pacific for Alcatel Data Networks and director of North American Corporate Development for Cable & Wireless.

Prior to joining Orrick, Scott worked at Jones Day and Sidley Austin in Hong Kong, and practiced in the United States, United Kingdom, and Japan for many years.

He obtained his Ph.D. in Chinese Religious Studies at Stanford University and J.D. at Georgetown University (cum laude). He was admitted to practice in Hong Kong, District of Columbia, and New York. In addition to English, Scott also speaks Mandarin, Japanese and French. 

Charles Allen

Partner, Complex Litigation & Dispute Resolution

Charles Allen heads the Commercial Litigation and International Arbitration practice in Hong Kong. He has over 20 years’ experience conducting high-value complex commercial litigation and arbitration in the Asia Pacific Region.

Advising and assisting on a variety of business disputes, as well as regulatory and other investigations, employment law issues and transactions, Charles acts for a range of clients, including individuals, private and listed companies, multinationals, conglomerates and financial institutions.

Charles conducts litigation in the High Court of the Hong Kong SAR, and is regularly involved in cases taking place in courts in other jurisdictions around the Region, including Mainland China, Singapore and India. Charles has handled numerous ad hoc and institutional arbitrations in Hong Kong, London, Lausanne, Paris and elsewhere under various rules including ICC, LCIA, UNCITRAL and LMAA, and has handled some of the highest profile arbitration-related litigation adjudicated on by the Hong Kong courts in recent years.  

Prior to joining Orrick, Charles was since 2007 a partner and a member of the Office of General Counsel of Sidley Austin in Hong Kong.

Charles obtained his LL.B. at University College London. He was admitted to practice in Hong Kong, and England and Wales.
