TOPIC: Equality in Employment: Discrimination Law update

Hong Kong tends to trail behind other jurisdictions on topics of individual equality in the workplace, but the landscape is changing in light of recent high profile cases such as QT v Director of Immigration and Leung Chun Kwong v Secretary for the Civil Service which aim to challenge the status of “marriage” for same-sex couples as it relates to workplace policies such as visas and benefits.

These cases come at critical time on the topic of human rights in particular with the pending appeal hearing on ZN v Secretary of Justice and the introduction of the Modern Slavery Bill. What are the implications if the legislation is passed? What can we learn from other jurisdictions?

With growing international debate regarding the gender pay gap and promotion of women - what are corporations doing in Asia in terms of self-governance?

International corporations operating in Hong Kong have proved to be a positive influence on these debates - but what is next?

In this collaborative discussion, we look at the changing landscape of equality and discrimination law in Hong Kong, as well as discuss the broader changes in the corporate context.


SPEAKER:

Julia Gorham, Partner

Julia Gorham is a partner of Seyfarth Shaw LLP and one of the founding partners of Wong, Wan & Partners, a firm of Hong Kong solicitors in Association with Seyfarth Shaw, a registered foreign law firm in Hong Kong.

Julia specialises in employment law, including international employment and human resources projects, employment law compliance, strategic risk management, litigious employment disputes, internal investigations and strategic advice at C-Suite and executive level.

David Smail, Associate

David Smail is an Associate in the International Employment group at Wong, Wan & Partners, a firm of Hong Kong solicitors in Association with Seyfarth Shaw, a registered foreign law firm in Hong Kong.  David is based in the firm’s Hong Kong office. He has experience of acting on a variety of contentious, non-contentious and advisory employment issues. David is dual qualified in Hong Kong and England & Wales.

His non-contentious work often involves an Asia Pacific cross-border element, including employment contract and employee handbook updates, transitioning employees on to new terms and conditions, transfer of employees, internal and regional restructures, and workforce harmonisations.
