TOPIC:  Terminating Senior Executives - Tips and Pitfalls & Protecting against the Departing Employee - Restrictive Covenants and Confidentiality

Employment partners from DLA Piper Hong Kong and China will lead a discussion focusing on the following issues:

  • How and why terminations of senior executives differ from those of more junior hires;
  • An overview of termination laws as applicable to senior executives in each of Hong Kong and China and how they differ; 
  • Top 5 practical tips for managing a senior executive departure to avoid common pitfalls;
  • Overview of the law on restrictive covenants in each of Hong Kong and China and how they differ; and
  • Strategies to adopt pre and post departure of a senior executive to maximize chances of enforceability.

SPEAKERS:

Helen Colquhoun, Partner/Head of Employment Hong Kong

Helen Colquhoun is triple qualified in New York, England and Wales, and Hong Kong. She advises employers across a range of industries on both contentious and non-contentious employment issues such as risk management, restructuring, managing employee hiring and terminations, design of incentive schemes, and drafting contracts and handbooks.  Helen frequently advises overseas employers on their operations in Hong Kong, including in relation to mandatory compliance requirements and best practice for employers in Hong Kong, immigration advice, secondments, dual contracts and general HR matters.

Johnny Choi, Partner/Head of Employment China

Johnny Choi supports multinational clients on all types of legal matters that involve their employees, including employment contracts, remuneration, data privacy, layoffs, employee IP infringements and ethical violations. Johnny regularly advises clients at the senior management level on employee disputes. He successfully defended a number of technology companies against IP theft by their staff, and advised on related data privacy issues. He also supports various clients on highly contentious removal of company executives and large scale redundancies. Recently, Johnny has advised life science companies and airlines on investigations into serious misconduct or corruption by employees. He also advises financial institutions and retail companies on the design and implementation of employee compensation and incentive schemes.
