With the development of the Belt & Road initiative, Chinese companies actively invest in over 60 jurisdictions that form the Belt & Road area. In many cases, these are developing jurisdictions or jurisdictions in transition, where investment comes with high sovereign risks. China maintains a network of over 140 investment protection treaties that safeguard Chinese investors from expropriation, nationalization, or other forms of undue interference with their investment in the recipient States. A large part of China’s outbound investments is structured through Hong Kong. Hong Kong maintains its own investment treaty program with over 10 contemporary investment protection treaties. These treaties are a valuable resource for investors to protect their investments in cases of undue interference. The presentation will cover the main aspects of investment protection under Chinese and Hong Kong treaties. It will be of interest to Chinese and Hong Kong investors with overseas investment projects.
